Aqueous Film-Forming Foams (AFFF) Products Liability Litigation MDL No. 2873

This website has been prepared and is maintained by the Court-appointed Plaintiffs’ Executive Committee (the “PEC”) of the Aqueous Film-Forming Foams (“AFFF”) Products Liability Multi-District Litigation (“MDL”) No. 2873. The MDL was established in 2018 and is currently pending before the Honorable Richard Gergel in the United States District Court of South Carolina, Charleston Division. The PEC was appointed to act as the primary contact between the Court and plaintiffs’ counsel.

Thanks to the PEC’s efforts – as well as those of trial counsel and the settlement negotiation teams – the first water provider settlements for Public Water Systems (“PWS”) to treat their drinking water were announced in June, 2023. Settlement agreements have now been reached with the 3M Company (“3M”); E.I. DuPont de Nemours and Company n/k/a EIDP, Inc., The Chemours Company, The Chemours Company FC, LLC, DuPont de Nemours, Inc., and Corteva, Inc. (collectively, “DuPont”);  with Tyco Fire Products LP (“Tyco”); and with BASF Corporation (“BASF”). 

The 3M PWS Settlement is for up to $12.5 billion; the DuPont PWS Settlement is for $1.185 billion; the Tyco PWS Settlement is for $750 million; and the BASF PWS Settlement is for $316.5 million.

The 3M and DuPont PWS Settlements have been granted final approval by the MDL Court. Other AFFF-related litigation, falling outside the scope of these agreements, continues in the MDL.

While the Settlements share certain similar terms and conditions, they also differ in important ways as well. Please consult the defendant-specific documents for full details.
